    Who Qualifies for Workers’ Compensation Death Benefits in Louisiana?

    Close family members of a worker who died on the job are considered dependents for the purposes of awarding workers’ comp death benefits in Louisiana.

    Loved ones with a potential right to death benefits include:

    • A spouse who lived with the worker
    • Children under the age of 18
    • Children 23 years old and under who are full-time students
    • Children who have disabilities that prevent them from earning a living (at any age)
    • Other family members, such as parents, who depended on the financial support of the deceased worker

    Widows or widowers of workers who died can receive benefits for life in the form of weekly payments. If they remarry, the benefits will stop.

    Your eligibility to claim death benefits lasts for two years after the last medical treatment of the person who died as a result of a workplace injury.

    What Do Workers’ Comp Death Benefits Pay?

    The amount you receive from workers’ comp death benefits depends on factors such as the income your loved one earned, the number of dependents who receive payment, and your relationship to the worker.

    Qualifying survivors receive a percentage of the worker’s wages up to a limit set by the state, which changes from year to year.

    Here is how it works:

    • 32.5% of wages: for a widow or widower who is the only dependent or a child who is the only dependent
    • 46.25% of wages: for a surviving spouse and one child or for two children and no other dependents
    • 65% of wages: for a surviving spouse and two or more children or for three or more children alone
    • $8,500: for funeral and burial expenses
    • $75,000: in a one-time, lump sum payment to nondependent adult children of the worker or surviving parents of the worker if the worker had no dependents

    Some benefits could also go to siblings who depended on the worker’s support or people who were partially dependent on the worker. These benefits come after other dependents receive their payments.
